Council Minutes

January 16, 2006

Regular Meeting


The Governing Body of the City of Victoria met in regular session on January 16, 2006 at 7:30 PM in Council Chambers of City Hall.


Roll Call

Council Members Jan Piesker, Leroy Schmidtberger and Neil Nickelson present.  Absent Ilona Patterson and Joe Robben.

Presiding

The Honorable Mayor Curtis B. Unrein.

Also Present

Bob Dinkel, Jay Dinkel, Russell County News Reporter Daniel Kiewel, Police Chief Don Pruitt, City Superintendent Julius Windholz, Patrol Officer Thomas Garner, City Attorney Don Hoffman and City Clerk Mary Pfeifer.

Minutes

Minutes of the December 19, 2005 regular meeting were presented for review.  Motion by Leroy Schmidtberger, second by Neil Nickelson to approve the minutes as submitted.

Vote: 3 Ayes 0 Nays, Motion declared carried.

Minutes from the Victoria Housing Authority, Victoria Rec Commission and the November and December minutes from the Victoria Fire Department were also reviewed.

Warrant Ordinance A-01-06

Ordinance A-01-06, consisting of bills against the City for the month of December was presented for review.  Motion by Neil Nickelson, second by Leroy Schmidtberger that Ordinance A-01-06 be approved and all bills paid.

Vote: 3 Ayes 0 Nays, Motion declared carried.

Agenda

Motion by Jan Piesker, second by Neil Nickelson to approve the agenda with modifications of Dollar General.

Vote: 3 Ayes 0 Nays, Motion declared carried.

Incentives

Bob and Jay Dinkel would like to construct a duplex and were wondering if council would give them some incentives that new home owners are receiving.  After a short discussion,  Motion by Jan Piesker, second by Leroy Schmidtberger to give Bob and Jay Dinkel one-half off a water tap and waive all building permit fees when constructing their duplex.

Vote: 3 Ayes 0 Nays, Motion declared carried.

Police Department Report

Police Chief Pruitt gave his department report.  Pruitt reviewed some of the calls for the month. 

City Superintendent Report

City Superintendent Julius Windholz gave department updates.  The motor on water well #11 froze and burned up.  The motor can be rebuilt or replaced.  It would probably be beneficial to replace it with a submersible instead of hollow shaft motor it now has.  Both will be costly.  Motion by Neil Nickelson, second by Leroy Schmidtberger to replace the motor with a submersible pump along with any additional costs not to exceed $5,500.00.

Vote: 3 Ayes 0 Nays, Motion declared carried.

 

Windholz would like to check into prices for a valve exercise machine.  Consensus of the council was to get some estimates.  Hays has several pool filters they would give to Victoria.  They also gave the city the name of an individual who can help set up the system.  He will come and help get everything planned out.  Windholz and Terry Riedel will be attending  training in January.  The new tires for the refuse truck have been mounted and the old ones sold.

 

7:58 PM Councilmember Joe Robben entered council chambers.

 

Council questioned Windholz on whether he felt some sort of water conversation plan should be implemented.  The city does have a drought emergency plan with Kansas Rural Water and there are trigger points in the plan.  None of those have been reached but they will be monitored. 

Ordinance B-482

AN ORDINANCE PROVIDING FOR THE REESTABLISHMENT OF THE VICTORIA CITY PLANNING COMMISSION: PRESCRIBING THE NUMBER, QUALIFICATIONS AND MANNER OF APPOINTMENTS OF ITS MEMBERS; DESCRIBING ITS POWERS AND DUTIES; DESIGNATING IT AS THE BOARD OF ZONING APPEALS AND PROVIDING FOR THE EXPENSES OF ITS OPERATION.

 

Thereupon, Council Member Joe Robben moved that said Ordinance be passed.  The motion was seconded by Council Member Leroy Schmidtberger.  Said Ordinance was duly read and considered, and upon being put, the motion for the passage of said Ordinance was carried by the vote of the Governing Body, the vote being as follows:

 

Yes: Joe Robben, Leroy Schmidtberger, Jan Piesker, Neil Nickelson

No: None

 

Thereupon, Mayor Unrein declared said Ordinance duly passed and the Ordinance was then numbered Ordinance No. B-482 and was signed and approved by the Mayor and attested by the City Clerk.  The City Clerk was directed to publish the Ordinance one time in the official newspaper of the City.

CDBG Grant  

The city would like to apply for a CDBG Grant.  Consensus of the council was to try to get the grant to replace water lines.  EBH will be contacted to see if they can attend the next meeting to get the grant process started.

 

1973 Ford Truck Bids


Sealed bids were received for the 1973 Ford truck the city has for sale.  They were as follows:

Francis Windholz                      $2,137.78

Victoria City Motors             $575.00

Julius Windholz             $500.00

Tom Schulte                             $1,000.00

Duane Dorzweiler                    $1,500.00       

Jay Dinkel                                $1,517.98

Motion by Neil Nickelson, second by Jan Piesker to accept the bid of $2,137.78 submitted by Francis Windholz.

Vote: 4 Ayes 0 Nays, Motion declared carried.

Mileage Rate

The IRS mileage rate for 2006 has been set at 44.5 cents per mile.  Motion by Neil Nickelson, second by Leroy Schmidtberger to comply with the IRS mileage rate of 44.5 cents per mile for 2006.

Vote: 4 Ayes 0 Nays, Motion declared carried.

Emergency Plan

The Emergency Plan was discussed and consensus of the council was to work on updating the plan.

Executive Session

8:21 PM Motion by Neil Nickelson, second by Leroy Schmidtberger to go into executive session for the evaluation of Thomas Garner with Police Chief Don Pruitt for 15 minutes.

Regular Session

8:36 PM Return to regular session.

Salary Increase

Motion by Jan Piesker, second by Leroy Schmidtberger to give Patrol Officer Thomas Garner a 3 per cent salary increase.

Vote: 4 Ayes 0 Nays, Motion declared carried.

Business Interest  

Councilmember Jan Piesker asked if any progress had been made on contacting Dollar General about the possibility of locating in Victoria.  Mayor Unrein will get in contact with the company.

Unfit Structures

Council would like to see letters sent to several residents about the unfit structures on their property.  City Attorney Hoffman will get them sent out.

All business on hand having been discussed, Motion by Neil Nickelson, second by Leroy Schmidtberger to adjourn the meeting.
