FENCES

PERMIT REQUIRED:  A zoning permit is required before construction of a fence is begun.

DEFINITIONS

FENCE:  A free-standing structure of metal, masonry, glass, plastic or wood or any combination thereof, resting on or partially buried in the ground and rising above ground level, and used for confinement, screening or partition purposes, but which does not pose a threat to public safety or health.

SCREENING:  Fencing or evergreen vegetation maintained for the purpose of concealing from view the area behind such fences or evergreen vegetation. When fencing is used for screening, it shall not be less than six nor more than eight feet high, unless otherwise provided.

REGULATIONS

PERMITTED OBSTRUCTION IN REQUIRED YARDS:  In any yard except a front yard; accessory uses permitted by Article 6, …open and closed fences not exceeding six feet in height with additional height permitted for security design measures.

FENCES IN A FRONT YARD:  On lots with single or two-family dwellings and all types of manufactured and mobile homes, fences not exceeding four feet in height are permitted which are constructed with at least 75% open space. In all other circumstances, including decorative walls as perimeter boundaries and entryways to subdivisions, open and closed fences are permitted which do not exceed six feet in height. Additional security design measures may be placed above the six feet limitation.

CONSTRUCTION STANDARDS FOR ALL FENCES:  No fence shall be constructed which will constitute a hazard to traffic or a danger to persons or animals.

CONDITIONAL USE FOR FENCES:  The City of Colwich Board of Zoning Appeals may as a conditional use approve the construction of higher fences and/or less open space in all yards or in any district if the Board finds that the public welfare is preserdsved.

SIGHT TRIANGLE:  On all corner lots in all districts, no use of land shall commence or no structure shall hereafter be constructed, structurally altered, extended, enlarged or moved after the effective date of the zoning regulations unless it also conforms to the requirements of the sight triangle as defined by Section 2-102. A triangular area as defined by City Ordinance 359 to provide a clear and unobstructed viewing area of traffic at intersections. (Note: Contact the City staff for sight distance requirements which vary with speed limits.)

SETBACKS:  25 ft front yard setback from all lot lines abutting a street for six (6) foot board fences except in Country Hill, one front yard setback on a corner lot may be 15 feet if the sight obstruction ordinance can be complied with. Otherwise fences may be placed along the property line along the rear and side yards of the property.

EASEMENTS:  No principle or accessory building or structure or use, or portion thereof shall be permitted to locate on or project over any platted or recorded public easement or over any known utility installation….the property owner assumes the risk and liability for any reconstruction or replacement necessary including fences if any maintenance or other improvements are required by the City or a utility company.

ACCESSORY USES

PERMIT REQUIRED:  A zoning permit is required before construction begins.

CARPORTS:  Attached or detached carports are not allowed with such residential uses.

EASEMENTS:  No principle or accessory building or structure or use, or portion thereof shall be permitted to locate on or project over any platted or recorded public easement or over any known utility installation….the property owner assumes the risk and liability for any reconstruction or replacement necessary including fences if any maintenance or other improvements are required by the City or a utility company.

GARAGES:  A garage may be 720 sq. feet. For a larger structure a conditional use permit must be completed and approved by the Board of Zoning Appeals.

HEIGHT:  No accessory building shall be more than one story high nor exceed 15 feet in height.

LIMITATIONS:  No accessory structure shall be constructed and occupied on any zoning lot prior to the time construction begins on the principal structure to which it is accessory.

Conversely, no accessory structure shall continue to be used or occupied after the principal structure has been removed from a zoning lot.

SETBACKS:  There must be five (5) feet from the rear lot line, except that garages with entrances facing alleys shall be set back at least 10 feet. There must be five (5) feet from a principal structure unless it is attached to and forms part of the principal structure.

STORAGE BUILDINGS:  A storage building may be 400 sq. feet. For a larger structure a conditional use permit must be completed and approved by the Board of Zoning Appeals.
