Edward Everett, For Plaintiff. --------------, For Defendant. ===== On this 1st day of February, 1879, came the said Plaintiffs by their Attorneys, Edward Everett, and filed herein their Bill of Particulars, praying judgment against the said Defendant for the sum of $87.50, on an account of merchandise sold and delivered. Stephen Girard entered as surety for costs. Plaintiff filed his Affidavit for Garnishment. Summons issued to Isaac White, Constable of Topeka Township, returnable on the 6th day of February, 1879, at 9 o'clock A.M. Garnishee Summons issued to Isaac White, Constable for W.B. Astor, to answer on the 6th day of February, 1879, at 3 o'clock P.M. February 6th, 1879, Summons returned and filed, endorsed in substance, served by leaving a duly certified copy at the usual place of residence of the Defendant, A.T. Stewart. Garnishee Summons returned and filed, endorsed in substance, served by delivering a duly certified copy to W.B. Astor, the said Garnishee. At the expiration of the hour, proceedings were had as follows: Plaintiffs appeared by Edward Everett Esq., their Attorney. No Appearance was made on the part of the Defendant. James Fisk, sworn in behalf of the Plaintiff. After hearing and considering the proofs and allegations of the parties, the Court finds for the Plaintiff in the sum of $87.50. It is therefore considered and adjudged, that the said Plaintiff, Amos Lawrence and Abbot Lawrence, have and recover of the said Defendant, A.T. Stewart, the sum of Eighty-seven Dollars, and Fifty Cents, and cost of suit as herein taxed at $8.20, as entered in items in the margin hereof. Witness My Hand this the 6th day of February, 1879, B.F. MERIDETH, Justice of the Peace. February 6th, 1879, W.B. Astor, Garnishee, appeared and made written answer under oath, that he is indebted to the Defendant, A.T. Stewart, in the sum of $42.50, now due. It was thereupon ordered that the said Garnishee, W.B. Astor, pay unto this Court the said sum of $42.50, or hold the same subject to the order of the Court. In obedience to said order, W.B. Astor, Garnishee, has this day paid into my hands the sum of Fourty-two Dollars and Fifty Cents, and is discharged as Garnishee in above action. Witness My Hand this 6th day of February, 1879. B.F. MERIDETH, Justice of the Peace. February 10th, 1879, Plaintiffs filed their Affidavit for Garnishment. February 10th, 1879, Garnishee Summons issued to Isaac White, Constable for the Great Eastern Railway Company, to answer on the 21st day of February, 1879, at 10 o'clock A.M. February 21st, 1879, Garnishee Summons returned and filed, endorsed in substance, served by delivering a duly certified copy to Jay Gould, Treasurer of the Great Western [sic] Railway Company Garnishee, he being the person designated by said corporation for service of papers. During the hour appointed Jay Gould, Treasurer and Agent of said Garnishee, the Great Eastern Railway Company, appeared and made written answer under oath, that the said Garnishee was indebted to the said Defendant, A.T. Stewart, at the time of the service of the Summons, in the sum of $131.00. It was thereupon ordered that the said Garnishee, the Great Western [sic] Railway Company, pay into this Court the sum of Seventy Dollars, to cover the judgment and payable costs of this suit. Witness My Hand this 21st day of February, 1879. B.F. MERIDETH, Justice of the Peace. February 21st, 1879, the Defendant W.B. Astor [sic], appeared and filed his affidavit, that the amount of indebtedness answered to by the Garnishee, the Great Eastern Railway Company is the result of the personal earnings of the Defendant within the last past six months, and is necessary to the support of his family. Thereupon, the said Garnishee, was by me released from said order and discharged. Witness My Hand this 21st day of February, 1879, B.F. MERIDETH, Justice of the Peace.
