Bell, For Defendant. ===== On this 1st day of February 1879, came the said Plaintiff by his Attorney C.M. Allen Esq., and filed herein his bill of particulars praying judgment against the said Defendant for the sum of $35.25, amount due for Work and Labor. February 1st, 1879, Summons issued to Isaac White, Constable of Topeka Township, returnable on the 4th day of February, 1879. February 4th, 1879, Summons returned and filed, endorsed in substance, served by delivering a duly certified copy to said Defendant, Silas Ent. February 4th, 1879, the Defendant filed his affidavit for a continuance. Thereupon the trial of this case was continued until the 6th day of March, 1879, at 10 o'clock, A.M. March 2d, 1879, Subpoena issued for J.A. Howell, M.A. Tracy and E. Jones, in behalf of Plaintiff. March 3d, 1879, Subpoena returned and filed. March 3d, 1879, Subpoena issued for A.B. Moon, M. Dunn and O. Fuller, in behalf of Defendant. March 4th, 1879, Subpoena returned and filed. March 6th, 1879, the Defendant by his Attorney, K.B. Bell Esq., filed his answer. March 6th, 1879, the Plaintiff appeared in person and by his Attorney, C.M. Allen Esq. March 6th, 1879, the Defendant appeared in person and by his Attorney, K.B. Bell Esq. Proceedings were had as follows: R.A. Eggers, J.A. Howell and M.A. Tracy, were sworn in behalf of the Plaintiff. Silas Ent, A.B. Moon and M. Dunn, were sworn in behalf of the Defendant. At 6 o'clock P.M. the further hearing of the case was adjourned until the 7th day of March, 1879, at 9 o'clock A.M March 7th, 1879, the hour having arrived, and both parties being present in person and by Attorneys, further proceedings were had as follows: Subpoena issued for John Tweed. Subpoena returned and filed. John Tweed sworn in behalf of Plaintiff. Oscar Fuller sworn in behalf of Defendant. After hearing and considering the proofs and allegations of the parties, and the arguments of the Counsel, the Court finds for the Plaintiff in the sum of $24.45, being for Work and Labor. It is therefore considered and adjudged that the said Plaintiff R.A. Eggers have and recover of the said Defendant, Silas Ent, the sum of Twenty-four Dollars and Fourty-five Cents, for Work and Labor and costs of the suit as herein taxed at $20.75 as entered in items in the margin hereof. March 15th, 1879, undertaking of Defendant for appeal to the District Court of Shawnee County, approved and filed. Gave certified transcript of 8 folios undertaking for appeal and all other papers in this action and transmitted them to the Clerk of the District Court of Shawnee County.
