CIVIL ACTION NO. 5. IN REPLEVIN. ATTORNEYS. M.F. Burke, For Plaintiff. ----------- For Defendant. ===== On this 5th day of February, 1879, came the said Plaintiff in person, and by his Attorney, M.F. Burke, Esq., and filed herein his Affidavit in Replevin for the return of one Roan Horse five years old, of the value of $120.00, wrongfully detained by the Defendant, Alfred Jones, and for damages for said detention in the sum of $17.00, and for the possession of the said property. February 5th, 1879, Undertaking in Replevin approved and filed. February 5th, 1879, Summons in Replevin issued to Isaac White, Constable of Topeka Township, returnable on the 9th day of February, 1879, at 10 o'clock, A.M. February 9th, 1879, Summons in Replevin returned and filed, endorsed in substance, served by delivering a duly certified copy to Alfred Jones, the said Defendant. February 9th, 1879, Isaac White, Constable of Topeka Township, filed his Affidavit, that the Defendant, Alfred Jones, did refuse to produce and deliver the property described, to wit: One Roan Horse, five years old, of the value of $120.00. February 9th, 1879, Commitment issued to Isaac White, Constable of Topeka Township, directing that the said Defendant, Alfred Jones, be committed to the Jail of Shawnee County, unless he produce and deliver the property in question. February 9th, 1879, the Defendant filed his Affidavit for a Change of Venue, on account of bias and prejudice of the Justice of the Peace against him. Thereupon, the trial of this action was changed to William Miller, a Justice of the Peace of Monmouth Township, Shawnee County, Kansas, and all the papers in the case, together with a certified transcript of all proceedings had by and before me were transmitted to the said Justice of the Peace.
