Ricco, For Defendant. ===== On this 18th day of January, 1879, personally cam John Hale before me B.F. Meredith, a Justice of the Peace, in and for Topeka Township and County of Shawnee, and made written complaint under oath, charging that on or about the 15th day of January, 1879, one S. Camp, did then and there threaten him with the said John Hale, with personal injury by unlawfully assaulting and beating him, and that he has just cause to fear and does fear the commission of said offense. Warrant for the arrest of S. Camp, issued to Isaac White, Constable. Subpoena issued for P. Green, V.I. O'Let, A.U. Bum and D.K. Blue. January 19th, 1879, Warrant returned and filed, endorsed in substance, executed by arresting S. Camp, and have him before the Court. January 19th, 1879, Subpoena returned and filed. January 19th, 1879, Subpoena in behalf of Defendant issued for J.O. Maley, J. Smith, H.P. Larmer [sic] and Oliver True. Subpoena returned and filed. The parties all being present, State by Attorney G.W. Black Esq., and the Defendant in person, and by his Attorney, P. Ricco, Esq., proceedings were had as follows: The following named witnesses were sworn in behalf of the State, P. Green, V.I. O'Let and D.K. Blue. J.O. Maley, J. Smith, A.P. Larimer and Oliver True, were sworn in behalf of Defendant. After hearing the proofs and allegations of the parties, the Court finds that the case was brought without any cause, and from malicious motion by the said John Hale. It is therefore considered and adjudged, that the said Defendant, S. Camp be discharged and that the costs of this suit as taxed be paid by the complaining witness, John Hale, and case of failure to make such payment, that he be committed to the jail of Shawnee County, to remain until payment is made or secured.
